A M'sian Man Sued JPJ Director-General Over 'MADANI' Plate Idea... And He Actually Won!

If you’ve ever pitched a brilliant idea to a massive organization only to watch them reject it, and then magically launch it themselves a year later, this historic court case is going to feel incredibly satisfying.


In a classic "David vs. Goliath" moment, a local Malaysian businessman just proved that intellectual property laws apply to absolutely everyone in this country. Yes, even the highest-ranking government departments.

1. "Thanks, but no thanks"—The 2023 pitch that got rejected 


The whole drama started back in 2023 when Hasan Azhari Hashim, the program director of Ilham Madani Sdn Bhd, came up with a creative concept: issuing a special vehicle registration number plate series running from MADANI 1 to MADANI 9999.


Hasan did the smart thing: he did his paperwork and officially registered his detailed concept paper under the Intellectual Property Corporation of Malaysia (MyIPO).


He proudly pitched the concept to the government multiple times in 2023, hoping for a great collaboration. The government's official response? A solid no. They turned down his proposal, claiming that public policy since May 2018 no longer allowed private companies or NGOs to sell special vehicle number plates.


Fair enough, right? Except...


2. The RM2.6 million rollout that triggered the lawsuit


Imagine Hasan's pure shock when October 2024 rolled around, and the Road Transport Department (JPJ) officially launched its very own public bidding exercise for the exact MADANI 1 to MADANI 9999 series.


The government's auction was a massive commercial hit, raking in a staggering RM2.62 million in revenue over a single weekend (with the plate "MADANI 6" scoring the highest bid at RM68,888!).


But Hasan noticed something incredibly familiar. It wasn't just the "Madani" name; the official promotional posters released by JPJ shared striking structural similarities, graphic themes, and typographic styles with the copyrighted pitch deck he had submitted to them.


Feeling completely shortchanged, Hasan issued a letter of demand in late 2024 seeking RM1.3 million in damages. When that failed, he officially filed a lawsuit against the JPJ Director-General on January 15, 2025.


3. "Let him try his luck"—How Anthony Loke reacted 


When the dispute originally exploded in public, Transport Minister Anthony Loke didn't seem too worried about the legal threat.


Addressing the media in November 2024, Loke stated that the sole legal authority to register special vehicle numbers lies exclusively with the Transport Ministry under the Road Transport Act 1987. He added that you couldn't technically copyright a number plate itself, playfully telling reporters:


"If he wants to sue, let him try his luck."


Well, Hasan took that advice literally, walked right into the Kuala Lumpur High Court, and let the legal process play out.


4. The defense argued "Madani isn't a new word" (The judge disagreed) 


During the trial, the JPJ Director-General's defense team tried to shut down the lawsuit by arguing that the word "Madani" was a widespread public slogan used by the Malaysian government since January 19, 2023. They claimed Hasan didn't invent or own the word, so he had no right to block a government policy initiative.


However, High Court Judge Datuk Edwin Paramjothy Michael Muniandy saw through the defense.


The court ruled that while the government might own the policy and the slogan, they did not own the right to appropriate someone’s registered creative expression without permission. Because Hasan had formally copyrighted his specific proposal paper layout and presentation, JPJ's promotional execution crossed the line into copyright infringement.


Ultimately, the High Court ordered the JPJ Director-General to pay Hasan RM40,000 in statutory and additional damages, plus RM25,000 in legal costs. JPJ has exactly one month to file an official appeal if they wish to challenge the ruling.
